'Innocent until proven guilty'. The PROOF of his guilt was questionable at best and highly suspect at worst. Assuming you accept the morality, effectiveness or the necessity of the death penalty, we need to at least be absolutely certain the person in question is actually guilty. Considering the amount of times inmates on death row have been proven to be falsely imprisoned/ executed brings into question the legitimacy of the death penalty.
